MERCHANTS’ RESPONSIBILITY

The merchants shall apply and register for its participation in the BCCIs Buffex Online Market Portal and satisfy the requirements for eligibility to participate.

The merchants guarantee legitimacy of their business operations and the products they offer for sale. The BCCI reserves the right to screen participating merchants and to check if their products are legitimate, authentic, do not infringe on any copyright or intellectual property rights, not harmful to health, and in accordance with other standards set forth by law in the Philippines.

The merchants shall inform the BCCI and coordinate with its representative on the status of their store in the portal, such as the display of their products, and other pertinent information relating to their sales transaction that may be required under this Agreement.

The merchants are solely responsible for the consummation of the sale and the delivery of the products as well as for guaranteeing satisfaction of the customers. Collection of payments for their products shall be their sole responsibility. Warranties and guarantees are the sole responsibility of the merchants. The BCCI will not participate in the negotiations of sales unless specifically requested by the buyer or the seller.

The merchants are subject to existing trade and internal revenue laws. It shall comply with these laws as compliance will be their sole obligation to the government. This includes registration of their businesses as well as issuance of registered receipts and invoices.

BUYERS’ RESPONSIBILITY

As much as possible, buyers are to transact their purchase transactions directly with the merchants. They may, however, make inquiries and coordination through the BCCI if they need assistance. The choice of merchants is their sole prerogative.

Buyers are to exercise diligence in dealing with merchants. They are expected to satisfy the requirements of the merchants before product delivery.

BCCI’s RESPONSIBILITY

The BCCI shall be responsible for the creation, uploading and maintenance of the on-line market portal in the web.

It is responsible for the solicitation of participating merchants, their selection and screening subject to standards set forth by the organizers. It reserves the right to kick-out sellers who may be found to be engaging in unscrupulous business practices, or violating any business law in the Philippines, engaging in scams or fraudulent business transactions, selling fake, expired, or products harmful to health or illegal in the Philippines.

The BCCI may entertain queries from both merchants and buyers. It will endorse potential merchants that may satisfy the requirements of inquiring buyers, and coordinate transactions between buyers and merchants, if so requested by either party.
